Labour Inspectorate Division

BACKGROUND

 

The Labour Inspectorate of Trinidad and Tobago began functioning before the Ministry of Labour and Small and Micro Enterprise Development came into existence in 1956. The first integrated regulation of the Labour Inspectorate was the Wages Council Ordinance which came into effect in 1949. This Ordinance gave authority for the fixing of minimum wages and terms and conditions of service for workers within certain sectors. It was recognized, even at that time, that labour inspection services were critical in contributing to a stable industrial relations climate in Trinidad and Tobago.

 


ROLE AND FUNCTION

 

The Labour Inspectorate Unit is responsible for educating and advising employers and employees about the relevant Labour Legislation and assists them in ensuring compliance.

Labour Inspectors investigate complaints and conduct routine inspections of businesses. Where breaches are discovered, voluntary compliance is sought, failing which, legal proceedings can be initiated at the Industrial Court.

  • Employees covered by the provision of the Legislation;

  • In the case of the Minimum Wages Act, all minimum wage workers;

  • In the case of Maternity Protection Act, all female employees.
